GENERAL TERMS AND CONDITIONS OF SALE

  1. Definitions

 

  • 'Item(s)': Item(s) that can be purchased on the Webshop.
  • 'Consumer': Any natural person who purchases the Items made available by the Seller on the Webshop exclusively for non-professional purposes.
  • "Buyer" means any party acting as the buyer of the Seller's Items, whether a natural person/Consumer or a legal entity.
  • 'Force Majeure': A situation of force majeure refers to (but is not limited to): labour dispute, natural disaster, fire, mobilisation, epidemic or pandemic, embargo, prohibition of foreign exchange transfer, insurrection, lack of means of transport, general supply problem, restriction of employment and energy and any other event not within the control of the Seller, the (temporary) cessation of activities or production by the manufacturer of (parts of) the Items,  as well as the influence of legal, regulatory or other regulations that prevent certain (parts of) the Articles from no longer being produced or offered.
  • "Party" means Buyer or Seller.
  • "Parties": Buyer and Seller.
  • "Seller" means RHR Concepts as defined under Section 1.
  1. General

 

  • These General Terms and Conditions of Sale apply to all sales by the Seller of Items to a Buyer via the Webshop. They replace any previous general terms and conditions of sale of the Seller. The possible application of general terms and conditions of sale of the Buyer or any other third party is hereby expressly excluded.
  • In order to place an order, the Buyer must be at least 18 years of age or older. If the Seller becomes aware that the order has been placed by a minor, it reserves the right to refuse the order.
  • By placing an order on the Webshop, a distance sale is created between the Parties.
  • By placing an order with the Seller via the Webshop, the Buyer is deemed to accept these General Terms and Conditions of Sale in full and without any reservation.
  • Deviations from these General Terms and Conditions of Sale may only be made with the specific written approval of the Seller.
  • The possible nullity of any provision of these General Terms and Conditions of Sale may in no case entail the nullity of the other provisions. In that case, the parties will make every effort to replace any void provision with an equivalent and valid provision.
  • The Seller reserves the right to change these General Terms and Conditions of Sale and the prices at any time as long as the contract has not yet been concluded.

 

  1. Order and confirmation

 

  • To purchase an Item online on the Webshop, the Buyer must click on the icon of the shopping cart and then on the "checkout" button. To complete the order, you must fill in your billing details or log in via your personal account where your billing details have already been entered in advance. The Buyer can then select the preferred delivery method (shipping or collection) and a payment method. This information will then be repeated before the Buyer can give an agreement for the placement of the order.
  • The Seller assumes that the billing information entered by the Buyer is correct. The Seller is of course not liable in the event of fraud or deception or in the event of errors by the Buyer as a result of which an order cannot be executed or can only be carried out with delay.
  • If the order process has been successfully completed, the order will be confirmed to the Buyer by e-mail. Attached to the e-mail will be attached to both the General Terms and Conditions of Sale and the invoice in PDF format.
  • The order confirmation and invoice will be kept by the Seller for as long as it is legally permitted. The Buyer can obtain these again and again on express request.

 

  1. Praise

 

  • All prices on the Webshop are displayed in EUR and include VAT unless otherwise stated.
  • Discounts or promotions are valid for the duration as indicated on the Webshop.

 

  1. Payment method

 

  • The Seller reserves the right to refuse any order from a Buyer with whom a dispute is ongoing or with whom a dispute has already arisen in the past.
  • The Buyer's bank account will be debited upon confirmation of the purchase, and the payment will only become effective once the Buyer's bank has given its agreement to the Seller regarding the payment.
  • In case the Buyer's bank refuses payment, the order will be automatically cancelled.
  • The Seller accepts the following payment methods: iDeal, Bancontact, bank transfer, In3, Klarna, Mastercard, Visa and PayPal.
  • The Buyer assures that it is lawful to make online payments using one of the above payment methods and that there is sufficient coverage in the bank account to cover all costs arising from the transaction.

 

  1. Delivery of the order

 

  • If the Buyer places an order on the Webshop before 23:59, the order will be shipped the next day.
  • The duration of the delivery period depends on the following two factors, but will always be a reasonable period:
  • The availability of the Item in the Seller's inventory. If the item is not in stock, the delivery time may take longer. The Seller will inform the Buyer of this before the order is placed with the description of the Item on the Webshop.

    • The Items are shipped from the depot in the Netherlands located at the address mentioned above. The Seller calls on the DPD delivery service for the delivery.
    • If the Buyer places an order above 35 EUR, no shipping costs will be charged. If the Buyer places an order under 35 EUR, the Buyer will be obliged to pay the shipping costs. The amount of the shipping costs will vary depending on the country where the order must be delivered. For an overview: See here.
    • The Items will be delivered in a box, including a clear assembly instructions, the instructions for use and the form for the withdrawal from the contract.

 

  1. Picking up the order

 

  • The Buyer may also choose to collect the ordered Items on site from the depot at the address indicated above from Monday to Friday during opening hours from 08:00 to 16:00.

 

  1. Right of Withdrawal for Consumers

 

  • If the Consumer wishes to cancel the purchase after delivery, he must inform the Seller in writing by e-mail by filling in the withdrawal form (https://economie.fgov.be/sites/default/files/Files/Forms/Formulier-herroeping.pdf) or any other unequivocal statement within 14 days of receipt of the Items.
  • In that case, the items must be submitted by the Consumer as soon as possible, but in any case within 14 days following the notification as indicated under 9.1. return to the address of the depot as mentioned above. The Items must still be packed in their original packaging and must be unused.
  • The shipping costs for returning the Items from the Consumer to the Seller are always at the expense of the Consumer.
  • Upon receipt of the returned, unused Items, the original packaging will be checked and if there is no damage, the amount due will be refunded to the Consumer in the same way as the payment was made when ordering.
  • In the event of damage to the packaging and/or the Items, the Consumer will be notified by email by the Seller. In this case, the Consumer is not entitled to a refund of the Items. In that case, the Items will remain at the disposal of the Consumer for 14 days at the depot or will be transferred back to the delivery address specified when ordering at the request and at the expense of the Consumer.

 

  1. Force majeure

 

  • Any order for Items may be terminated by the Seller after simple written notice and without compensation or its execution may be postponed if a Force Majeure situation arises.
  • In the event of a delay in the execution of the order for Items due to Force Majeure, the Buyer also has the option, if the situation of Force Majeure persists for more than 14 calendar days, to cancel the order without any compensation being due.

 

  1. Guarantee

11.1. Returning faulty and/or damaged Items is only possible if the Buyer informs the Seller by e-mail within 8 calendar days of receipt of the Item in order to obtain a return agreement from the Seller.

11.2. In the event of a return agreement, the Seller will replace the Item, or, in consultation with the Buyer, provide an alternative Item or refund the price of the returned Item. In any case, the Seller will never be obliged to pay any compensation.

11.3. In the event that the Buyer is a Consumer, the Buyer will be able to benefit from a two-year warranty from the date of delivery for any lack of conformity that manifests itself within two years, unless the Item has a shorter lifespan. In this case, the warranty is limited to the lifetime of the Item. This guarantee can only be invoked if the Consumer reports it within two months of discovering the lack of conformity.

 

  1. Liability

 

12.1. The Seller is not liable for damage that the Buyer or a third party may suffer as a result of the non-functioning or improper functioning of the Items, as well as for damage as a result of non-timely, incorrect or incomplete deliveries or availability of the Items, except in the event of intent or gross negligence on the part of the Seller or its staff or appointees. Nor shall there be any liability on the part of the Seller if the Items are used incorrectly by the Buyer or a third party.

12.2. The Seller shall under no circumstances be liable for any indirect, consequential, immaterial or trading damage. In the event of liability for direct damage, any compensation will never exceed the amount of 10x the value of the purchased Items.

12.3. However, any limitation of liability in Articles 12.1 and 12.2 shall not apply if the damage concerns physical injury or death.

 

  1. Complaints

 

  • If for any reason the Buyer is not satisfied, he can always contact the customer service who can be reached at the contact details mentioned in article 1 from Monday to during the opening hours from 09.00 to 16.00. Customer service will respond as soon as possible, but no later than within 14 days, to try to resolve the complaint as quickly as possible and satisfactorily.

 

  1. Applicable law and the competent court

 

  • All legal relationships are exclusively governed by Dutch law.
  • If the contract is concluded between the Consumer and the Seller, the court of the Consumer's domicile will have jurisdiction to hear the dispute. For the other disputes, the District Court of Zeeland-West-Brabant with sitting in Breda will have jurisdiction.
